As per the rules, it is mandatory to link PAN with Aadhaar before the March 31 deadline. With the Supreme Court (SC)upholding the government requirement that PAN must be mandatorily linked with Aadhaar, Section 139AA of the Income Tax Act comes into play. As per this section, if your PAN is not linked with Aadhaar by a date to be notified by the government then it would be deemed to become invalid. Currently, the deadline for this has not been set by the government although those who have filed ITR for FY16-17 without linking PAN with Aadhaar are required to do the same by March 31, 2019. 

 

Failing which, users will not be able to file Income Tax returns or claim refund. Also, if there is a mistake in your PAN card and you have not got them corrected then you will not be able to complete important tasks like filing the income tax return. PAN card is a mandatory document for financial transactions and filing tax returns.

 

PAN card details of several people are printed incorrectly. These may include spelling of the user's Name, father's name or birthdate. If this is the case with you then correct it soon, otherwise, you will not be able to file income tax returns. For the first time, people who have filed their returns may not be aware that a slight mistake in PAN card or ITR form can prove costly.

 

There is no need to feel hassled to update the PAN card. You can update it online, from the comfort of your home in a few minutes. However, you need to have all the necessary information before updating. 

 

Here is how to Link :

 

1. Visit www.incometaxindiaefiling.gov.in

 

2. Under the 'Quick links' head, click on 'Link Aadhaar' option.

 

 

3. A new page will open on your computer screen. On the screen, a new hyperlink will be reflecting allowing you to view status of PAN-Aadhaar linkage. 

 

 

4. After clicking the hyperlink, you will be required to enter your details- PAN and Aadhaar number. 

 

5. Enter the details and click on 'View Link Aadhaar Status’. 

 

 

Actually, to get the spelling of your name on the card corrected via e-mail, you will have to fill in a form. You can download this form at http://www.incometaxindia.gov.in/archive/changeform.pdf With this form, you will have to submit documents as proof to correct your name. If an incorrect name is printed on the PAN card due to the mistake made by the Income Tax Department, then you can submit  the document on which your name is printed correctly. If you have changed your name, you will have to give a copy of the official gazette in which the changed name was printed.

 

After this, you will receive an e-mail from the income tax department, which will have details of your changed name. After you approve the changes, your name and address will be updated. The entire process will take only a few days.

The CBDT had extended the deadline for PAN-Aadhaar linking to 31st March, 2019.

 

The CBDT has via an order under section 119 of the income tax act extended the deadline to link PAN with Aadhaar for taxpayers who have filed ITR for FY 2016-17 without linking PAN with Aadhaar to March 31, 2019. Therefore, returns filed by such taxpayers will not be processed if they do not link PAN with Aadhaar by March 31, 2019. The Supreme Court in its judgement dated September 26, 2018 on Aadhaar has upheld that PAN must be mandatorily linked to Aadhaar.
