Tamil Nadu imposes stricter restrictions on online real-money gaming

The new online gaming regulations aim to balance player safety and business growth, amidst ongoing industry discussions and challenges surrounding regulatory consistency in India's rapidly expanding gaming sector

 

 

In a bid to better regulate the rapidly growing online real-money gaming (RMG) sector, Tamil Nadu has introduced a series of stringent gaming regulations designed to protect players and curb potential risks. These newly implemented Tamil Nadu gaming rules come amid a national debate over the future of online gaming in India. The state’s move follows recent legal challenges and comes in the wake of the need for clearer online gaming restrictions within the sector.

Key aspects of Tamil Nadu's new gaming regulations

The regulations introduce a host of new measures aimed at improving user protection in the RMG space. A key rule mandates a “blank hours” period between midnight and 5 a.m., during which players will not be able to access games, aiming to reduce the potential for compulsive or excessive gaming behaviour.

Additional measures include mandatory pop-up warnings that inform users of the addictive nature of online gaming. These warnings will appear after players have been engaged for an hour, with recurring alerts every 30 minutes thereafter. RMG platforms must also allow users to set daily, weekly, and monthly spending limits, and provide clear access to their transaction histories to enhance transparency. These features are meant to give players more control over their spending habits.

In a move to ensure responsible gaming, Tamil Nadu has also implemented a strict Know Your Customer (KYC) process for all new users. The KYC procedure requires Aadhaar-based identification and OTP verification, ensuring that only eligible individuals, excluding minors, are allowed to participate in real-money gaming.

The newly formed Tamil Nadu Online Gaming Authority, headed by retired IAS officer Md. Nasimuddin, will oversee the enforcement of these regulations. The authority will be responsible for issuing platform registrations, monitoring compliance, and handling grievances. It will also have the power to classify games as "games of chance," which could lead to their suspension if necessary.

Legal and regulatory hurdles facing the gaming industry

Tamil Nadu's approach to online gaming regulation is part of a larger conversation around gaming industry news in India. While the new rules aim to balance player safety with the growth of gaming businesses, they come at a time when the broader industry faces challenges in regulatory consistency.

The state's previous attempt to ban online rummy and poker was overturned by the Madras High Court, which allowed regulations focused on playtime and age restrictions. These Tamil Nadu gaming rules are seen as an extension of that ruling, ensuring that gaming remains within legal bounds.

India currently lacks a unified national framework for online gaming. While the Ministry of Electronics and Information Technology (MeitY) has explored self-regulatory organizations (SROs) as a possible solution, a national policy has yet to emerge. Tamil Nadu's regulatory changes reflect the state's commitment to managing the growth of the online gaming sector while addressing the risks associated with gambling. These developments will likely shape the future of the gaming industry in India, driving further innovation while balancing safety and regulation.
